Is the employee entitled to paid leave during a CDD?

An employee in CDD has the same paid leave rights as an employee in CDI.

The employee in CDD is entitled to 2.5 working days by month of actual work with the same employer. This corresponds to 30 working days (5 weeks) for a full year of work.

So it doesn't exist no minimum duration requirement the CDD to be able to benefit from paid leave.

If the CDD employee has not completed a full working month, the calculation of his paid leave is made in proportion to the number of days worked in the month.

The number of days of paid leave shall be rounded up to the next higher number.

Example :

A CDD employee worked 20 days in May (31 days), working 35 hours per week, 7 hours per day (Monday to Friday).

At the end of the month, the employee earned the following number of paid holidays: 2.5 working days x (20 / 31) = 1.61 days.

The number of days of paid leave shall be rounded up to the next higher number.

The employee therefore benefits from 2 days of paid leave at the end of May.

If the employee has not taken all his paid leave earned before the end of your CDD, then he benefits from a compensatory allowance for paid leave.

The amount of the allowance is calculated on the basis of the actual length of his CDD.

It is at least equal to 10% of its gross total compensation perceived.

The allowance is paid to the employee in CDD at the end of his employment contract unless his CDD is chased by a CDI.

If the employee in CDD is sued by a CDI, he does not lose the days of paid leave acquired not taken. The employee can take this leave acquired during his CDD later during his CDI.

FYI  

The employer may, however, refuse to agree to grant paid leave to the employee according to certain circumstances.
