Verified 31 August 2026 - Public Service / (Prime Minister)
The medical examination of resumption of work is not not systematic.
In which cases is the return medical examination mandatory?
The a medical examination is resumed mandatory if the employee was on sick leave for any of the following reasons:
- Accident of non-occupational origin or illness of non-occupational origin resulting in a work stoppage of at least 60 days
- Accident at work which led to a shutdown of at least 30 days
- Occupational disease (regardless of the duration of the shutdown)
- Maternity leave.
The return medical examination must be organized by the occupational physician of the prevention and health service at the request of the employer. It must take place in the 8 calendar days from the resumption of the employee's work.
The purpose of this visit is to verify the employee's ability to return to his or her position or to consider adjustments or reclassification if necessary.
In which cases is a medical check-up not necessary?
For work stoppages issued since June 15, 2026, the return visit is not required if the following 2 conditions are met :
- The employee received a pre-resumption visit within 30 days prior to his actual resumption of work
- During that visit, the occupational physician concluded that no individual measures to adjust, adapt or transform the post or any measures to adjust working time were necessary in order to resume work.
This exemption does not apply if the employee, employer or occupational physician requests that the resumption visit take place.
What is a Pre-Resumption Visit?
A pre-resumption visit can be organized for employees on sick leave more than 30 days.
It may be requested by one of the following persons:
- Employee
- Attending physician
- Medical Adviser of the Social Security
- Occupational physician.
This visit aims to anticipate the conditions of the recovery and to facilitate the return to employment.
During the pre-resumption visit, the occupational physician may recommend, in particular:
- adjustments or adaptations of the workstation,
- recommendations for reclassification,
- vocational training to facilitate the reclassification of the employee or his vocational reorientation.
The occupational physician informs the employer of the organization of the pre-resumption visit, unless the employee objects.
FYI
It is possible, under certain conditions, to carry out the return visit by teleconsultation. The employee and the doctor must give their consent. In addition, the technical conditions must allow clear and secure communication (video and audio connection of sufficient quality). However, if, during the teleconsultation, the doctor considers that the conditions are not met for a complete evaluation, he may decide to cancel the session and reschedule it in person.
