Is the salary of the janitor, caretaker or employee part of the rental expenses (recoverable on the tenant)?

Under certain conditions, the salary of the maintenance personnel (caretaker or janitor or employee) is part of the charges that the tenant must pay. These charges are said recoverable on the tenant.

Recoverable staff costs on the tenant are only remuneration (gross salary) and payroll taxes and tax.

They therefore do not include not the following expenses, which shall be borne by the owners:

  • The salary in kind
  • THEincentive and participation in company profits
  • Retirement allowances and bonuses
  • Severance payments
  • The contribution to a mutual fund covered by the employer
  • The contribution to occupational medicine.

Maintenance of common areas and removal of garbage cans

When the caretaker or caretaker of a building ensures the maintenance of the common areas and the disposal of waste (removal from the garbage), the expenses related to the salary are paid up to 75% by the tenant. The 25% the remaining are the responsibility of the owner lessor.

This allocation shall apply including:

Maintenance of common areas only (cleaning, watering, changing light bulbs...)

When the caretaker or concierge only takes care of the maintenance of the common areas, the expenses related to his salary are paid by the tenant up to 40%. The 60% the remaining are the responsibility of the owner lessor.

Dumpsters only

When the caretaker or concierge is only responsible for taking out the garbage according to the applicable regulations, the expenses related to his salary are paid by the tenant up to 40%. The 60% the remaining are the responsibility of the owner lessor.

Building employee

When the employee of the building manages the maintenance of the common areas or the disposal of waste (removal of garbage), the expenses related to his salary are paid in full by the tenant. These charges are thus fully recoverable by the owner.
