Voluntary Severance Pay in the Territorial Public Service (FPT)

You are a territorial agent and your position is being restructured during a reorganization of the service? You may, under certain conditions, be entitled to a voluntary severance payment if you decide to resign accordingly. We present you the conditions for awarding this allowance.
You can receive a voluntary severance if the following 2 conditions are completed:
- Your position is restructured during a reorganization of the service and you choose accordingly to resign
- There has been a deliberation to provide voluntary severance in your community.
The deliberation is taken after the social committee has given its opinion.
The deliberation shall determine the services, managers and grades concerned by the restructuring of the service and for which the voluntary severance allowance may be awarded.
It also sets out the conditions of award and the amount of severance pay.
In the absence of deliberationHowever, you are not eligible for voluntary severance pay.
You can claim the voluntary severance pay if you complete the following 2 conditions :
- You are an official or contract agent in DTA: titleContent
- You are more than 5 years from the minimum retirement age on the date of sending your request for resignation (the postmark being proof).
The steps to take to submit your resignation and apply for voluntary severance pay are set by each community as part of the deliberation.
Your community needs to specify what form the claim should take and when it should be made.
Before accepting your resignation, your community employer must verify that you meet the conditions to receive voluntary severance pay.
If you do not qualify for the allowance, your local authority must inform you that you will not be eligible for severance if you continue to resign.
The amount of voluntary severance pay is determined on a case by case basis, within the framework set by the deliberation, and may vary depending on your seniority in the administration.
The amount of the compensation may not exceed one maximum amount equal to 2 times your annual gross remuneration perceived during thecalendar year before you resigned.
The gross remuneration taken into account includes:
- Your index treatment raw
- Your premiums and allowances
- Residence allowance and the Family Treatment Supplement (FTS), if you benefit from these 2 additional remuneration.
The allowance is paid in one go once the resignation has become effective.
It is subject to the following contributions:
- Additional pension (RAFP), CSG, and CRDS if you are a civil servant
- Pensions (basic and supplementary), CSG, CRDS if you are a contractor.
The allowance is taxable.
You don't have to be again recruited as a probationary official or contract agent in the public service (State, territorial or hospital) within 5 years of your resignation.
Otherwise, you must reimburse your voluntary severance paywithin 3 years of your recruitment, to the local authority that paid it to you.
You can collect unemployment benefits if you meet the conditions to benefit from it.
