We present the rules regarding telework in the public service. They differ according to your public service (state - EPF, territorial - FPT, hospital - FPH).
EPF
Teleworking is a form of work organization that allows you to work away from your usual work premises through information and communication technologies.
If your employer administration has made telework possible, you are allowed to telework at your request.
However, in exceptional circumstances, teleworking can also be implemented at the request of the administration to ensure the continuity of the public service and the protection of staff.
Warning
On-call work (i.e. periods during which you must remain at home, at the disposal of your administration) and interventions during a on-call duty do not constitute telework.
You can do part of your work from home, whether you are civil servant or contract worker, if this activity can be carried out remotely, by means of computer tools.
The conditions for setting up teleworking are laid down by ministerial decree.
This Order sets out the following points:
- Activities that can be carried out in telework
- List and address of any business premises made available by the administration for the exercise of teleworking functions, number of workstations available and equipment
- Rules to be followed in the field of information system security and data protection
- Rules on working time, safety and health protection
- Conditions for access at the place of telework to the bodies responsible for ensuring the proper application of health and safety rules
- Conditions for checking and accounting working time
- Conditions for the administration to cover the costs arising directly from the exercise of teleworking (hardware, software, subscriptions, communications, tools, maintenance of such equipment)
- Training requirements for equipment and tools needed for teleworking
- Conditions for drawing up the certificate of conformity of the installations with the technical specifications if you telework at home or in another private place.
The conditions for the implementation of teleworking may be specified in each department or establishment after consultation of the specialized training on health, safety and working conditions of the Social Committee or, in the absence of specialized training, of that Committee.
Regular or occasional telework
Telework authorization may be granted for a regular or ad hoc recourse teleworking.
It may provide for the fixed teleworking days during the week or month.
You can inform your supervisor of your need to come to the site on a day for which you have a telework authorization and request to move that telework day.
If it is necessary or easy for you to organize or carry out your work, you can decide to carry out your activities in your workplace.
Your administration may request that you inform your supervisor.
The teleworking authorization may also provide for the allocation of a number of teleworking floating days per week, month or year that you can request to use from your line manager.
The same teleworking authorization may provide for these different possibilities.
Teleworking locations
You can telework at home or in a other private place or in a other business premises (such as a telecentre).
The same teleworking authorization may provide for these different possibilities.
Number of teleworking days allowed
The maximum number of teleworking days is fixed at 3 days a week for a full-time agent.
The number of working days in the department or the usual premises cannot be less than 2.
These thresholds can be calculated on a monthly basis.
However, if your state of health or disability justifies it, you can request to telework more than 3 days a week, for a maximum of 6 months renewable, after consulting the occupational physician.
You can also ask to telework more than 3 days a week in the following cases :
- During your pregnancy
- If you meet the conditions to benefit from a caregiver leave
- Temporarily due to an exceptional situation disrupting access to the service or on-site work.
Hardware
Your employer administration covers the costs arising directly from the performance of your telework duties : cost of hardware, software, subscriptions, communications and tools.
Your employer administration also ensures the maintenance of equipment.
The conditions for this support are defined by ministerial decree.
The administration is not obliged to cover the cost of renting a space for teleworking (in case of teleworking in telecentre).
If you are disabled, the administration can make the necessary job adjustments at your telework location.
However, such adjustments must not entail expenditure disproportionate to the financial aid available to the administration.
If you request the use of floating teleworking days or if you request to telework temporarily, the administration may authorize you to use your personal computer equipment.
Formulation of the request by the agent
You must submit your telework request by written.
You have to specify what the desired teleworking conditions : regular or ad hoc recourse, teleworking location(s), number of days desired.
If you wish to telework at home or in another private place, you must provide a attestation of conformity of the installations with the technical specifications defined by your employer administration.
If you change functions, you must submit a new telework application.
Your employer administration may have a telework application form in place. Ask your line manager.
Review of the application by the administration
Your employer administration examines the compatibility of your request with the nature of your activities and the interest of the service.
Your administration informs you of its decision in writing within one month of the date of receipt of your request.
When your administration organizes a survey of applications, it responds within one month of the application deadline.
Decision of the administration
Your telework request may be accepted or refused.
Acceptance
The authorization to exercise your functions in telework may provide for a adaptation period of up to 3 months.
The authorization shall include the following information:
- Functions exercised in teleworking
- Telework location(s)
- Conditions for the implementation of telework and, if applicable, the duration and time slots during which you carry out your activities in telework, are at the disposal of your employer administration and can be reached, in accordance with your work cycle or the usual working hours
- Start date of telework
- Possibly the length of the adaptation period.
The written authorization for telework is accompanied by an information document indicating the conditions for applying telework to your professional situation.
This document specifies in particular the nature and operation of the control and accounting systems for your working time.
It also specifies the equipment at your disposal and their conditions of installation and return.
This document specifies their conditions of use, renewal and maintenance and what technical support is provided by the administration.
The written telework authorization shall also be accompanied by the following documents:
- Copy of the conditions for setting up teleworking set by ministerial decree
- Document reminding you of your rights and obligations in terms of working time and health and safety
Refusal
If your administration refuses you telework, its refusal must be motivated and be preceded by an interview.
You can enter the CAP: titleContent, if you are a civil servant, or the CCP: titleContent, if you are a contractor, in case of refusal to a 1re request or request for renewal of telework.
Working time
Your duration and workload remain the same whether you work on-site or teleworking.
The maximum daily and weekly working hours, rest periods, breaks and working time accounting are identical on site and in teleworking.
Your supervisor, in consultation with you, sets the time slots during which he can contact you, consistent with the working hours in force in your department.
In the case of variable hours during the teleworked period, the call time slots are defined in the telework authorization.
During the annual evaluation interview, your supervisor must have an exchange with you on the conditions of your telework activity and your workload.
Accident at work
You have the same rights and obligations as an agent who works on the premises of the administration.
An accident that occurs during telework hours and in the context of the duties you perform in telework is considered an accident at work.
An accident can be considered a journey accident in the following situations:
- Journey between your home and your telework location (if your telework location is different from your home), including when detours of the journey for the necessities of everyday life (dropping off and taking back children, etc.)
- Journey between your teleworking location and the service, in case of temporary exceptional return to your service on a teleworking day
- Commute between your telework location and your usual dining location, during the working day.
Coverage of costs
You are entitled to an allowance that contributes to the reimbursement of expenses incurred as a result of teleworking.
This allowance takes the form of a lump sum allowance called telecommuting package.
The telework package can be paid to you if you telework in a telecentre provided that this space does not offer a catering service funded by your employer administration.
The amount of the telecommuting package is fixed at €2.88 per day of telework within the limit of €253.44 per year (i.e. 88 compensated days).
The teleworking package is not subject to any contribution.
The telework package is paid at the end of each quarter.
The teleworking package is paid based on the number of teleworking days you have requested and that have been authorized for you.
If necessary, it may be adjusted according to the days of telework actually carried out during the year.
This regularization occurs at the end of the 1er quarter of the following year.
Meal expenses
Your meal costs on teleworked days are at your expense.
However, if you are working from a telecentre, your employer administration may arrange a specific agreement with an administrative restaurant near your telecentre.
If your employer's administration awards restaurant vouchers, you benefit from these restaurant vouchers when you are working from home.
Telework may be terminated at any time, in writing, at your request or at the initiative of your employer administration, respecting a notice period of 2 months.
If it is your administration that terminates telework, the notice period may be reduced in the event of need for service motivated.
The interruption of telework at the initiative of the administration must be justified and preceded by an interview.
When telework is stopped during the adaptation period, the notice period is 1 month.
If you request the end of telework, this does not prevent you from reapplying for telework later.
FPT
