Is the employee entitled to participation and profit-sharing during parental leave?

When the company pays a premium of participation and/or incentive scheme for employees, the premium is received by the employee in parental leave if he has worked for part of the year taken into account for the calculation of entitlements.

A condition of seniority of the employee in the company may be required (3 months maximum).

The amount of the premium depends on the following award criteria of the participation or incentive agreement:

  • Either by a uniform distribution between each employee
  • Either in proportion to the salary paid to the employee
  • Either in proportion to the employee's time in the company.

Please note

If the employee has been absent during the whole year, he cannot receive a bonus if the allocation is made in proportion to the salaries or time in the company. The employee will be able to benefit if the agreement provides for a uniform distribution between all employees.
