When to rent the accommodation purchased with a PTZ, loan agreement or NOT?

Under certain conditions, you can rent the accommodation you have purchased with a PTZ, PAS or an agreed loan. These conditions depend in particular on the date of obtaining the loan:

Loan obtained since 2016
The rules vary depending on the time that has elapsed since the loan was disbursed:
Leasing within 6 years of loan payment
You can rent the property within 6 years of the date of payment of the loan, under the following conditions:
- You're in a special situation
- You apply specific rental rules.
Special situation
You must be in at least one the following specific situations:
- The home will become your primary residence upon retirement, which will occur in less than 6 years (less than 12 years after the loan is paid).
- You are on professional mobility. As a result, your new journey (outward) between your place of activity and the accommodation financed is at least 50 km or represents a transport time of at least 1h30.
- You divorce or terminate your Civil partnerships: titleContent.
- You are disabled or incapacitated and you have a disability card or a mobility inclusion card (MIC) marked “disability”.
- You have been unemployed for more than a year and your situation is confirmed by your registration with France Travail (formerly Pôle emploi).

Leasing is also possible in the event of the death of the borrower.
Specific leasing rules
You must respect all the following rules:
- The total rental period of the accommodation may not exceed 6 years.
- The accommodation must not be rented to serve as a furnished for tourism, or furnished dwelling, or second home or official dwelling.
- The rent does not exceed rent ceilings for social housing (type PLS).
- The tenant's income at the signing of the lease must not exceed resource limits for obtaining PLS-type social housing.
Warning
You must inform your bank of the rental of the accommodation. If you receive APL: titleContent for this accommodation, you must inform the Caf: titleContent (or the MSA: titleContent if you depend on the farm plan).
Leasing more than 6 years after the loan payment
You can rent the accommodation purchased with a PTZ: titleContent or an agreed loan or NOT: titleContent.
Loan obtained before 2016
The rules vary depending on the time that has elapsed since the loan was disbursed:
More than 6 years after the loan payment
You can rent the accommodation after 6 years from the date of payment of the loan, provided you have the agreement of your bank.
To do this, you need to send a letter to your bank. In this letter, you must present your situation (reminder of the loan and the housing concerned) and ask the bank if it opposes the rental of the housing.
If the bank does not object to the rental of the dwelling, the loan (NOT: titleContent, PTZ: titleContent or agreed loan) can be maintained and you can rent the accommodation.
Within 6 years of the loan payment
You can rent the accommodation before you have fully repaid the loan, if you respect the 2 following conditions:
- You're in a special situation
- You apply specific rental rules.
Special situation
