What if child support is not paid?

When the parent debtor don't pay child support, the parent creditor has means to recover the sums due.

If child support is not paid by the debtor parent, you can use the following amicable solutions:

You can recover child support payments due up to 5 years back at most.

To consider a forced recovery, you must have a court decision or of a parental agreement approved, or divorce agreement by mutual consent.

If child support is not paid or partially paid by the debtor parent, you can initiate one of the following procedures:

The direct payment procedure allows to cover arrears for the last 6 months only. On the other hand, the direct payment procedure makes it possible to anticipate the next installments of maintenance.

If the parent liable for the maintenance does not pay the maintenance in full during the more than 2 months, you can lodge a complaint for abandonment of family.

Ec offense shall be punished by 2 years' imprisonment and €15,000 of a fine.

Warning  

If the debtor parent considers that it can no longer fulfill its obligation, it is up to him to act and seize the Jaf: titleContent for ask for the decrease or deletion child support.

You can also file a complaint if the parent who is liable for child support fraudulently organizes or aggravates its insolvency. This offense is punishable by a sentence of 3 years in prison and €45,000 of a fine.
