Mandatory pension coverage for territorial agents by 2029

Publié le 05 novembre 2026 - Public Service / (Prime Minister)

Two decrees published in the Official journal of the French Republic of October 24, 2026 specify the modalities of the supplementary social protection in terms of the pension of territorial agents. They define the conditions for the establishment of a compulsory collective contract, the cases of exemption from membership as well as the minimum guarantees that must be offered to agents by 1er January 2029.

A compulsory collective pension contract

Local and regional authorities and their public institutions will have to put in place a collective pension contract to cover the risks of incapacity for work, invalidity, incapacity and death.

This contract will cover territorial civil servants, contract staff governed by public law (including childminders and family assistants), trainee civil servants and apprentices. That's what it says the decree of 23 october 2026.

Membership will be mandatory, except in certain cases provided for by the decree.

Are there any exemptions?

An agent may be exempted from joining the collective contract:

  • if recruited for a period of less than 6 months;
  • if he already has individual cover with equivalent guarantees for incapacity for work and invalidity, until the expiry of the contract and for a maximum period of 12 months;
  • if he is a non-full-time apprentice or agent and his contribution represents at least 10% of his gross remuneration.

Additional exemptions may be provided for by collective agreement.

What are the guarantees of protection?

The second decree published in the Official journal of the French Republic of 24 october 2026 lays down the minimum level of protection to be guaranteed to officials.

In the event of incapacity for work, the benefits paid must ensure that the agent maintains 90% of net income.

The text also provides for minimum guarantees in the event of invalidity.

How is the contribution paid?

The local authorities will pay part of the contribution paid under the collective pension agreement.

This participation may not be less than €15.

The new rules will come into force on January 1, 2029. However, if a pension participation agreement is already in force on that date, the new provisions will apply when that agreement expires.

If more than one territorial employer employs and pays the same agent, each employer shall pay a share of the participation in proportion to the time worked with him.

Please note

This reform implements the provisions of the law of 22 december 2025 on the supplementary social protection of territorial public officials and results from the national collective agreement concluded in the territorial civil service.
