A healthcare professional cannot prescribe a sick leave of more than 3 days via a telemedicine consultation, outside the attending physician and referring midwife. The « Anti-Fraud Law » n°2026-534 of 25 June 2026 - and more particularly its article 49 - reinforces the measures already taken to combat social and tax fraud.
Since 27 June 2026:
- the total duration of a work stoppage prescribed by telemedicine is limited to 3 days maximum (initial period + renewal) unless the renewal comes from the treating physician or if the patient is unable to consult a physician in person;
- persons arrested must inform their primary health insurance fund (CPAM) if they change their address during their work stoppage (e.g. to go to a relative's house).

A work stoppage may not be prescribed by means of a telemedicine procedure carried out by a health professional who carries out his activity primarily abroad.
