Agency fees may increase in 2026

Since 2014, real estate agency fees for renting a home were capped and had never been revised. An order of 17 July 2025 revalues these ceilings as of 1er January 2026, indexing them to the Rent Benchmark Index (RBI). Public Service explain.

The fees charged to tenants are currently capped for the following services:

  • visit of the accommodation;
  • constitution of the file;
  • drafting of the lease;
  • inventory of the entrance.

The decree of 1er August 2014 (taken under the ALUR law) had introduced a cap on the fees payable to tenants. This decree provided for the possibility of annual revision of the ceilings by ministerial decree, but no decree was issued between 2014 and 2025. This year, an order dated July 17 allows for a reassessment as of 1er January 2026. This is conditional on a positive annual change in the IRL, calculated between the 3e 2024 and 2025 quarters.

The agency fees charged to the tenant are governed by the law of July 6, 1989, which governs the relationship between landlords and tenants.

An upward revision as of January 1, 2026

For the year 2026, the IRL of 3e quarter 2025 is 145.77, which represents a 0.87% increase compared to 3e quarter 2024.

These new rules will apply only for leases signed from 1er January 2026.
