Discrimination at work

New information for employees engaged in an LDC or adoption pathway

The law published in Official Journal of 1er July 2025 aims to protect people engaged in a parental project of LDCs or adoption from possible discrimination at work. From now on, absence permits make their daily life easier. Service-Public.fr explains.

So far, only an employee with assisted reproductive technology (AHR) is eligible for leave of absence for all necessary medical procedures. Employed spouses of pregnant women or women receiving assisted reproductive technology are granted leave to attend 3 examinations or procedures for each protocol of the medical assistance program.

The law of 30 June 2025 sets out new measures to facilitate medical or administrative procedures when you are involved in assisted reproduction (MAP) or adoption.

Permits for absence are now available for:

  • male employees who require medical treatment for infertility;
  • their spouse or partner who wishes to accompany them;

The Law of 30 June 2025 creates specific absence authorizations for prospective parents engaged in a adoption procedure, so that they can attend the compulsory interviews necessary for obtaining approval. The maximum number of absence permits will be fixed shortly by decree.

These absences do not result in any reduction in pay. They shall be treated as a period of actual work for the purpose of determining paid leave and for legal or contractual rights acquired by virtue of seniority in the company.

Please note

Public officials shall be granted the same leave of absence private-law employees in the event of pregnancy, LDCs or adoption.
