Winter break 2025-2026: what you need to know

The winter truce is the period during which the eviction proceedings of a tenant by an owner are suspended. It is fixed from 1er November 2025 to March 31, 2026. However, the winter break does not apply in certain situations. Public Service presents the main modalities of the device.

During the winter break, which extends from 1er november 2025 until march 31, 2026, a landlord cannot evict a tenant, even if he has a court decision in his favor. This applies for any reason of eviction, including unpaid rent. Some people are not protected by the winter break:

  • persons receiving rehousing corresponding to their family needs;
  • residents of a dwelling located in a building affected by a security order;
  • squatters occupying a home, whether a primary or secondary residence;
  • squatters occupying a garage or land. In such cases, the judge ordering the expulsion may decide to abolish the winter truce or to reduce its duration;
  • spouses whose expulsion from the matrimonial home has been ordered by the Family Court Judge in the context of the non-conciliation order in divorce proceedings;
  • spouses, partners of abusive Civil partnerships or partners in their relationship or on a child, and whose expulsion from the family home has been ordered by the Family Court Judge under a protection order.

The winter break does not eliminate the accumulated rent debts. During this period, tenants must continue or begin debt repayment procedures.

At the end of the truce, if a decision to evict a tenant has been made by a judge, the procedure can be resumed and executed by a commissioner of justice.

Please note

It is the law of 24 March 2014 for access to housing and a renovated city planning (Alur) that set the present dates of the winter break; it always takes place from 1er November to March 31 of the following year. In certain circumstances, and in particular during a health crisis, the government may decide to extend this period or to take exceptional measures after the truce.

Reminder

The principle of the winter truce has been extended to cover gas and electricity cuts, which are also prohibited during this period.
