Et après ?

Immediately after the request, the Fiva sends an acknowledgement of receipt to the email address of the person making the request. He tells her if her file is complete.

As the case is examined, the Fiva may ask this person to provide additional documents.

If the Fiva deems it necessary, the person entitled may be received by an expert doctor, at the expense of Fiva.

In the 15 days following this email, the beneficiary receives a response from Fiva on the admissibility of his request.

The Fiva must make an offer of compensation in the 6 months from the date on which the request was sent.

If the offer is accepted, the compensation must be paid within 2 months of receipt of the agreement of the beneficiary and the documents allowing payment (example: RIB: titleContent).

The Fiva's decision can be challenged in any of the following cases:

  • The person making the request considers that the offer of compensation is insufficient in relation to the damage suffered
  • The Fiva has refused your request for compensation (explicit decision to refuse)
  • The Fiva did not respond to you within 6 months (implicit refusal decision).
