The steps are not the same for those who are already registered as for those who have to create an account.

Not yet registered
  1. Create an account using an email address
  2. Check your inbox and click on the account validation link
  3. Provide the personal information requested (Fiva file number, identity elements, social security number, etc.) and attach an identity document
  4. Choose the section “Aggravation of a situation already declared to FIVA”, then click on “create”
  5. Explain the reason for the request (worsening disease, new disease, etc.)
  6. Provide medical documents attesting to the victim's illness
  7. If necessary, download, complete and attach the asbestos exposure questionnaire
  8. Indicate the harm suffered by the victim and provide evidence related to such damage
  9. Validate Request
Already registered
  1. Log in using a username and password
  2. Choose the section “Aggravation of a situation already declared to FIVA”, then click on “create”
  3. Enter the personal information requested (FIVA file number, identity elements, social security number, mutual insurance, etc.) and attach an identity document
  4. Explain the reason for the request (worsening disease, new disease, etc.)

Et après ?

Immediately after the request, the Fiva sends an acknowledgement of receipt to the email address of the person making the request. He tells her if her file is complete.

As the case is examined, the Fiva may ask this person to provide additional documents.

If the Fiva deems it necessary, the victim may be received by an expert doctor, at the expense of the Fiva.

In the 15 days Following this email, the victim receives a response from Fiva on the admissibility of his request.

The response time is conditioned by the recognition, or not, of the right to compensation by a social security body.

Right to compensation already recognized by a social security organization

The Fiva: titleContent must make an offer of compensation within 6 months from the date on which the request was sent.

If the offer is accepted, compensation must be paid within 2 months upon receipt of the victim's consent and the documents allowing payment (example: RIB: titleContent).

FYI  

In the event of an occupational disease or if it is a disease whose finding is a justification for exposure to asbestos, it is possible to request a provision without waiting for the Fiva's response.

Right to compensation not yet recognized by a social security organization

In principle, the Fiva: titleContent must offer compensation within 6 months from the date on which the request was sent.

However, where a right to compensation has not been recognized, the Fiva: titleContent automatically forwards an application for recognition of an occupational disease to the victim's social security body.

In this case, the 6-month period is suspended until the social security body responds. The organization must make its decision in a 3 months delay renewable 1 time. If the FIVA does not take a decision within that period, it shall have a period of 3 additional months to make a compensation proposal.

The Fiva's decision can be challenged in any of the following cases:

  • The person making the request considers that the offer of compensation is insufficient in relation to the damage suffered
  • The Fiva has refused your request for compensation (explicit decision to refuse)
  • The Fiva did not respond to you within 6 months (implicit refusal decision).
