Joint Application for Approval of a Parenting Agreement (Form 16139*01)

1. Preparing the Convention to be approved (either the parental agreement - Residence and rights of access and accommodation, or the parental agreement - Alternate residence)
2. Gather documents necessary
3. Complete the registration form and print it
4. Send Convention, accompanied by the application form from the agreement to the competent court

The competent judge is, according to the choice of the parents, that of the place where one or the other resides.

Documents to attach in any case :

• Copy of your identity document: national identity card, passport...

• Civil status documents:
  
  • Full copy of your birth certificate less than 3 months old
  • Full copy of the birth certificate dated less than 3 months of each child concerned by your request
• Parental agreement accompanied by the present request for approval, signed by the 2 parents
• Previous court decisions if any (as applicable: copy of divorce or legal separation judgment, copy of any other court decision - judgment or order of the court, family judge or children's judge - related to your family situation or the subject of your application)

Documents to attach according to your request :

• Proofs of your homes (rent receipt, electricity bill...)
• Copy of your last tax notices and your last tax returns, your last three pay slips, proof of the social benefits you receive
• Copy of any document justifying your fixed expenses (accommodation, etc.)

The notice no. 52346#01 outlines the process to be followed.

The Family Court Judge shall approve the parental agreement without a hearing, unless he considers it necessary to hear the parties.
