As adopters, you must attach to your application the documents following:

  • Full copy less than 3 months old of your birth certificate
  • Full copy less than 3 months old of the birth certificate of your spouse, partner or common-law partner
  • Full copy less than 3 months old of the adopted child's birth certificate
  • Full copy less than 3 months old of your child's birth certificate if you have one
  • Photocopy of your family booklet and that of the adopted (marriage pages and children pages even if these pages are blank)
  • Full copy less than 3 months old of your marriage certificate, or the copy of the receipt of the joint declaration of Civil partnerships, or the certificate of cohabitation issued in the town hall if applicable or any other documents attesting to the cohabitation (certificates of title, production of a lease mentioning the 2 tenants, etc.)
  • Consent to adoption by parents, not deprived of their parental rights, made before a notary or before a French consular or diplomatic agent, or before the child welfare service that took in the child. If it is not possible to provide parental consent, please indicate all due diligence companies to try to find them.
  • Death certificate if the adopted person's parents have died
  • Copy of the court decision if the parents have lost their rights of parental authority as a result of the decision
  • Copy of the judicial decision declaring the child abandoned if the child has been judicially declared in a situation of parental neglect
  • Consent to the adoption of the family council or the ward family council of the State of the department in the event that the adopted person has no established parentage, or when both parents are unable to manifest their will or have lost their rights of parental authority
  • Accreditation of child welfare if the child is a ward of the Government or is handed over to an approved agency for adoption or is a foreigner
  • Acts of non-withdrawal of the adoptee's parents' consents after the expiry of the 2-month period
  • Consent to the adoption of the child if he or she is over 13 years of age before a notary or a French consular or diplomatic agent, or before the child welfare service that took in the child
  • Opinion of the ad hoc administrator on the appropriateness of the adoption project if the minor over 13 years of age is unable to personally consent to its adoption
  • Details on the choice of the adopted person's surname
  • Consent to change his or her first name if the adopted person is over 13 years of age
  • Certification on honor that you are « neither separated, nor legally separated, nor divorced, nor in the process of divorce »
  • Certification on the honor that the requested adoption is not likely to compromise family life if you already have one or more children
  • Advice from your adult children about the adoption project. If your children are minors, please specify their age and the relationship with the adopted child.

If you are from foreign nationality, you must attach the certificate of custom relating to the national law of the country of which you are a national, in matters of adoption, issued by the consulate or by a lawyer of that country.

If you are domiciled abroad, you must attach the certificate of custom relating to the law, in matters of adoption, of the country of your domicile, issued by the consulate or a lawyer of the country of which he is a national proving that the personal law of the child does not prohibit his full adoption (this does not concern the minor foreigner born and residing in France).

Et après ?

The hearing, if the judge deems it useful, takes place in council chamber. You are summoned by post or by e-mail to the address indicated in your request.

At the hearing, the judge hears your explanations, examines the documents provided to him and asks the questions he considers useful.

Its task is to verify that the conditions for adoption are met and that it is in the best interests of the adopted child.

The judgment shall be delivered in open court.

The registry of the court transmits a copy of the decision rendered.
