Diagnosis Noise from airports (state of air noise pollution)

Does the sale or rental of a property (house, land...) located near an airport require the realization of a Noise of airports diagnosis (also called state of air noise pollution) ? We tell you what you need to know.

The airport noise diagnosis informs the future buyer or tenant of the possible presence of noise nuisance related to air traffic may impact the property.

The airport noise diagnosis is mandatory when it concerns a property located in a airport noise exposure area defined by noise exposure plan (EPB), in one of the zones A, B, C or D (D being the least exposed).

The goods concerned are:

  • Residential buildings (house, apartment) or mixed buildings, i.e. for professional and residential use
  • The building land.

It is also possible to request information from the town hall.

Who shall I contact

The airport noise diagnosis must be completed directly by the owner/seller or lessor. It consists of a form entitled state of air noise pollution :

The document shall specify the following information:

  • Clear and precise indication of the noise zone
  • The address of the online information service to consult the EPB (i.e. portal cartes.gouv.fr)
  • The mention of the possibility of consulting the EPB at the town hall of the municipality where the building or land is located.

Sanctions may apply to the owner-seller or lessor:

Seller

The seller may be held liable if he does not transmit the diagnosis or if he provides inaccurate information in the advertisement of sale, misleading the future buyer.

The purchaser may appeal to the judicial court of the location of the property to request:

  • Cancelation of the sale, possibly accompanied by damages and interest
  • A reduction in the selling price, possibly accompanied by damages.

Lessor

The landlord may be held liable if he does not transmit the diagnosis or if he provides inaccurate information in the rental announcement, misleading the future tenant.

The tenant can appeal to the judicial court of the location of the property to request:

  • Cancelation of the lease, possibly accompanied by damages and interest
  • A reduction in the rent, possibly accompanied by damages.
