What absence permits are available to a public official in the event of pregnancy or assisted reproductive technology?

Leave to attend the mandatory interviews required to obtain approval for adoption

The law of 30 june 2025 to protect persons engaged in a parental project from discrimination at work introduce leave authorizations for public officials engaged in an adoption procedure to attend the mandatory interviews necessary to obtain approval.

The maximum number of leave authorizations that can be granted will be defined by a decree that remains to be published.

An official or a contractual person may be granted leave of absence during pregnancy for various reasons. A public official may also be granted leave of absence in the event of Assisted Reproductive Technology (ART), formerly known as medically assisted reproduction (MAP). Here are the rules for these different absence authorizations.

Pregnancy

If you are a civil servant (trainee or holder) or a contract employee, you benefit from a authorization of paid absence to conduct the compulsory medical examinations in the framework of the medical surveillance of pregnancy and of the effects of childbirth where such examinations must be carried out during working time.

Every pregnant woman shall be provided with medical surveillance of pregnancy and the aftermath of childbirth, including in particular compulsory prenatal and postnatal examinations carried out or prescribed by a doctor or midwife.

Mandatory medical examinations of pregnant women include 7 for a pregnancy progressing to its term.

The 1er examination prenatal medical care should occur before the end of 3e months of pregnancy.

The other tests must take place every month from 1er day of 4e month and until delivery.

One post-natal medical examination must be carried out within 8 weeks of delivery.

If it is public official or employee, the person who lives with you also benefits from leave of absence to attend 3 of these examinations compulsory medical treatment. The duration of the leave of absence shall be proportionate to the duration of the examination. These leave authorizations shall be treated as periods of actual work.

MPA

If you receive a Assisted Reproductive Technology (ART), you have a authorization of paid absence for necessary medical procedures where such medical procedures are to be carried out during working hours.

If it is public official or employee, the person who lives with you also benefits from leave to attend 3 of these medical procedures necessary for each protocol of the medical assistance route. The duration of the absence shall be proportionate to the duration of the document received. These leave authorizations shall be treated as periods of actual work.
