Can an employee resign during a work stoppage?

Yes, an employee may resign during a work stoppage prescribed for illness, occupational disease or a accident at work.

As a rule, the employee right perform a advance notice.

The starting point notice is the date of notification to the employer of the resignation, i.e. the moment when it becomes aware of it.

If notified by letter RAR: titleContent , the notice shall begin on the date of 1re presentation of the letter by the Post Office.

Where the resignation is effected by a discount in person against discharge, it's the day hand-delivery which fixed the starting point of the notice.

If the work stoppage ends after length of notice, notice is not extended and ends on the date originally scheduled.

If the work stoppage ends before At the end of the notice period, the employee must make the remaining period of his notice in the company.

The employee may be exempted from the remaining period of notice of resignation:

  • À his request and after acceptance of the employer (in writing to avoid any dispute). In this case, thecompensation for notice is not due.
  • Or the only one employer's initiative (in writing to avoid any dispute). The latter must then pour the compensation for notice for the period covered by the exemption.
