A labor court counselor is a lay magistrate. Its mission is to settle disputes between employer and employee at the labor court. When he is an employee, he benefits from time off to fulfill the tasks related to his function. He is allowed, under certain conditions, to be absent from work. The labor court member shall be granted time for activities related to his labor court function as well as for judicial activities.

Activities related to the labor court function include:

  • Oath-taking
  • Participation in the formal re-entry hearing
  • Carrying out administrative activities related to the functions of presidents and vice-presidents of the Council, section or chamber (if the employee holds such a position).

Jurisdictional activities include:

  • Preparatory study of a dossier
  • Participation in hearings
  • Participation in deliberation.

Employee labor court advisor can also benefit authorizations for absences for the purposes of his training.

Time off work during working hours is considered to be actual working time for the calculation of the employee's rights. For example, calculation of entitlements related to seniority or paid leave.

During his hours of absence, the employee labor counselor receives a compensation.
