Orphan's pension on the death of a civil servant

One of your parents died and he was a public servant? You can collect, under certain conditions, a orphan's pension. How do you know if you are entitled to it and what steps to take? We present you the information to know.

To receive the orphan's pension, you must complete one the following conditions:

  • Be under 21 years of age
  • Where to be, on the day of death of your mother or father who is a civil servant, at least 21 years of age and at the actual expense of your parent due to permanent disability which makes it impossible for you to earn a living
  • Or be reached, after death of your mother or father but before your 21e birthday, of a permanent disability which makes it impossible for you to earn a living.

To qualify for the orphan's pension, your parent does not need to have been a public servant for a number of years. It does not matter how long he served before he died.

You are considered unable to earn a living when your disability does not allow you to work or when your gross occupational income is less than €1,117.26 per month in the 12 months prior to your parent's death.

The orphan's pension is equal to 10% of the retirement pension of your deceased public servant parent or of the retirement pension that he could have obtained on the day of his death.

Example :

Your public servant parent was receiving or could have received a retirement pension of €1,500 per month.

Your orphan's pension corresponds to 10% of this pension, i.e. 1,500×10% =€150 per month.

If your deceased public servant parent had or could have had a invalidity pension (due to service-related disability), the orphan's pension is increased by 10% the amount of that disability pension.

Example :

If your parent also had a invalidity pension of €200 per month, the orphan's pension shall be increased by 10% of this pension i.e. 200×10% = €20 per month.

Therefore the total of your orphan's pension will be 150 + 20 =€170 per month.

You can also benefit from all or part of the survivor's pension if your other parent has died or is not entitled to the survivor's pension.

The survivor's pension is equal to 50% the retirement pension that your deceased public servant parent was or could have been receiving.

Example :

If the other parent has died or is not entitled to reversion.

Your public servant parent was receiving or could have received a retirement pension of 1,500 per month.

The survivor's pension is equal to 50% of €1,500, or €750.

As a result, the cumulative total (orphan's pension + survivor's pension) will be 170 + 750, i.e. €920 per month.

The total amount of the survivor's and orphan's pensions may not exceed the amount of the retirement pension and, possibly, the invalidity pension which the deceased official was or could have been entitled to.

In the event of overage, the orphan's pension is temporarily reduced.

If you receive the orphan's pension because of a permanent disability that makes it impossible for you to earn a living, the orphan's pension cannot be combined with any other pension or annuity of a general scheme up to the amount of these benefits.

If your two parents died and were public servants, it is possible to accumulate the reversion of your father and your mother.

The orphan's (and survivor's) pension may be granted from the day following the day of death.

The payment of the orphan's (and survivor's) pension is made at the end of the month following the month of death.

The orphan's pension is paid until your 21ste If you are under the age of 18, it is paid to your legal representative unless you are emancipated.

If you are unable to earn a living, the pension is paid to you as long as you meet the conditions to receive it.

It ceases to be paid in the following situations:

  • You cease to be unable to earn a living
  • Your gross business income exceeds €1,117.26 per month.

The payment of the orphan's pension can be reinstated if your professional income falls below the authorized ceiling.
