Guardianship, curatorship, family empowerment, safeguarding of justice: how to obtain the medical certificate?

The request for the opening of a judicial protection measure (guardianship, curatorship or family authorization) must be mandatory accompanied by a detailed medical certificate. It is a condition of admissibility of demand. To obtain this certificate, you must contact a medical specialist entered on a list drawn up by the Public Prosecutor. We explain the process to follow.

The detailed medical certificate:

  • Describes degradation (tampering) the faculties of the person
  • Give the guardianship judge any information on the foreseeable evolution of this alteration
  • Specifies whether the middle finger should be assisted or represented in the acts of everyday life
  • Indicates whether the hearing of the person by the judge is likely to harm his health or if the person is unable to express his will in relation to the situation.

This certificate must be written by a a specialist physician on a list established by the public prosecutor. These doctors are often psychiatrists, geriatricians, neurologists, sometimes general practitioners.

Most doctors travel to the place of residence of the person to be examined (home, hospital, Ehpad: titleContent, retirement home).

The detailed medical certificate cannot be issued by the attending physician of the person to be protected. However, the doctor responsible for drafting it may seek the opinion of the treating doctor if necessary.

Warning  

If the person to be protected refuses to be examined by the doctor responsible for drawing up the detailed medical certificate, the doctor may nevertheless draw up the certificate on the basis of the documents in the medical file. It may also, if necessary, seek the opinion of the treating physician.

The list of doctors authorized to draw up the medical certificate is available from the registry of the guardianship judge of the court on which the domicile of the adult to be protected or protected depends.

Who shall I contact

The cost of the medical certificate is €192 (€160 excluding tax).

Its cost is the responsibility of the protected major, unless it does not have sufficient resources or the judge decides otherwise.

When the expert doctor goes to the protected adult, he can charge travel expenses.

Warning  

Not all licensed physicians travel to their homes.

When the physician is mandated by the court and establishes a certificate of deficiency because he was unable to speak with the adult to be protected, a lump sum compensation of €30 it is paid to him.

The detailed medical certificate is not reimbursed by the Social Security, as it is a medical document made in the context of a judicial procedure. This is not an act of care.

This certificate is given by the doctor to the person who requests it, in a sealed envelope, for the exclusive attention of the public prosecutor or the guardianship judge.

It cannot be transmitted by dematerialized means in order to guarantee the confidentiality and security of this document.
