Fraud against Social Security: what consequences?

In case of Social Security fraud, you can be punished in several ways. These sanctions can range from a simple warning to a prison sentence.

Examples of situations in which you risk a penalty
  • Failure to declare a change in situation (end of the situation of a right holder for example), except in good faith
  • False statement on a claim form for entitlement and benefits
  • Do not tell the truth when declaring situation and resources for benefit payment
  • Refusal to provide information, failure to meet invitations, incomplete or unduly late response to the organization's requests
  • Fraudulent acquisition of a Social Security number
  • Acts to obtain unjustified benefits under the prevention professional account (C2P)
  • Abuse the status of social insured to obtain unjustified prescriptions for work stoppage unrelated to his state of health.
Penalties that may be imposed on you

The penalty results in the repayment of amounts unjustly collected.

Depending on the situation and the seriousness of the offense, the penalty may be one of the following:

  • Suspension of benefits
  • Warning, financial penalty, except in case of good faith of the insured
  • Fine or imprisonment.

Please note

Any person who deliberately refuses to affiliate or who persists in not engaging the steps for his compulsory affiliation to a social security scheme is punishable by imprisonment of 6 months and a fine of €15,000 (or only one of these penalties).
