Modification of an urban planning authorization

You got a urban planning authorization. Your building permit (PC), planning permit (PA) or non-opposition to your prior declaration (DP) is valid. You want to make small changes. You can request to change the permission obtained. However, if you change the nature of the original project, you must submit a new application for authorization.
Step-by-step approach
You can submit an amendment application if your project meets the following 2 cumulative conditions:
Validity of the initial urban planning authorization
Your PC, PA or non-opposition to your DP must still be valid. The works granted must not be completed.
Warning
An amendment may be granted even if a record shows that the current works do not conform to the original permit.
If your works is completed, you can also request a change to your original authorization in order to regularize it, if it is the subject of an appeal.
Limited modifications respecting the nature of the original project
Your PC, AP, or DP can be changed if the overall design of the project is retained. The proposed amendments should not change the nature of the project.
The conditions are different depending on whether it is a PC, AP or DP:

PC or DP
In the case of a PC or a DP, the modification request is adapted to carry out small changes to the exterior appearance of the initial project. It can also be used to edit the footprint or the floor area of construction.
Conversely, you must file a new application for a PC or DP to make more significant changes (for example, a large increase in the surface area or the change destination of the project).
PA
In the case of an AP to create a subdivision, the amending permit is required to make small modifications, for example, to modify the access road, correct the numbering of the parcels, add plantations, modify the footprint or the floor area.
Conversely, you must file a new application for a PA, in particular, to change the allocation of the subdivision, or extend its scope.
To check if a change request may be sufficient to change the current authorization, you must consult the urban planning department of your town hall or the Basu: titleContent for Paris.

Prior declaration
Your request for DPS The amendment must be dealt with in accordance with the urban planning into force regulations at the time the amendment is issued.
Building Permits and Development Permits
Your request for PC or PA The amendment, filed within 3 years of the date of issue of the original permit, shall be examined in accordance with the urban planning regulations in force on that date. However, post-regulation is necessary if it preserves public safety or health (e.g. risk of land subsidence or flooding, deterioration of water quality or noise pollution in an inhabited area). In this case, your request may be refused or your authorization accompanied by requirements.
The examination of your application only concerns the elements to be modified, the rights acquired by the initial authorization are not called into question.

The method of transmitting your file differs depending on whether you are in the province or in Paris.
General scenario
You must submit your request for modification file to the town hall:

Request the amendment of a valid or regularized authorization
The town hall issues you with a receipt. It contains the registration number of your file and the information telling you the date from which the works will be able to start.
In Paris
You must file your change request file at Basu: titleContent only by dematerialized means.

Warning
In a municipality of more than 3,500 inhabitants, a legal person must submit its application forurban planning authorization only by electronic means.
From the reception in town hall of a complete file, the processing time for your change request is different depending on the authorization to change:
- 1 month for a DP
- 2 month for a single home PC
- 3 months for a PC other than a single-family home (e.g. for a commercial or agricultural building...) or an AP).
However, within one month of the filing of your file, the City Hall, or the Basu: titleContent for Paris, may contact you to warn you that another deadline is applicable. This is the case when your project requires the consultation of other services such as the ABF: titleContent for example.
If you have not received anything by the end of the 1er The initial deadline cannot be changed any longer after your deposit.
You can also be informed that your project corresponds to a case where tacit permit is not possible. This is the case, for example, if your project involves a building listed as a historic monument or if your project is in the heart of a national park.
Warning
If your file is incompletewithin one month of its deposit, the town hall, or the Basu: titleContent for Paris, ask you to complete it within a maximum of 3 months. The period of investigation shall begin to run from the receipt of the missing documents by the town hall or the Basu: titleContent.
If you do not submit the missing documents within the time limit, the application is rejected by tacit decision.
Authorization to modify your PC, PA or DP is not a new PC, PA or DP. The decision concerns only the amended points. It is signed by the mayor and sent to you by letter RAR: titleContent.

Authorization or lack of response
The authorization decision shall take the form of an order. You can start your works.
You may not receive a response within the time limit you have been given. In this case, your license or amending DP is accepted. On request from you, the town hall, or the Basu: titleContent for Paris, must issue you a certificate of tacit or no-objection permit at tacit DP. This is a proof of agreement and certifying that there is no opposition to your project. You thus have proof to assert your rights (obtaining a loan, taking out insurance).
Warning
In certain specific cases, the absence of a written decision from the town hall, or the Basu: titleContent for Paris, means refusal of your request. For example, if your project is in a classified site, in the heart of a national park, if your project is refused by the government or concerns a building listed as a historic monument.
Authorization with prescriptions
Your request is accepted subject to one or more requirements requirements.
The town hall, or the Basu: titleContent for Paris, take a arrested with specific rules to be respected. You must then run the works according to these imposed rules.

Refusal
If your project is refused, the town hall, or the Basu: titleContent for Paris, take a opposition order. It's a refusal decision.
This Order only applies to the amendments requested in your amending permit. It does not call into question the initial authorization.

Stay of proceedings
In certain circumstances, the Mayor, or Basu: titleContent for Paris, may postpone its decision on your request for amending authorization for up to 2 years. This is the case, for example, when your request for works may compromise or make it more expensive to implement a future MORE: titleContent or a development operation.
The mayor, or Basu: titleContent for Paris, take a stay order. The reasons for the decision and the remedies and time limits for appeal shall be specified. It only addresses the changes requested in your request for amending authorization. It does not call into question the initial authorization.
Your request is neither accepted nor refused. It will be considered later. At the end of the maximum period of 2 years, different grounds may justify a new decision to stay proceedings. In this case, the total duration of the stay of proceedings is limited to a maximum of 3 years.
Within 2 months of the expiry of the period of validity of the stay of proceedings, you must confirm your application for an amending authorization. Within 2 months of your request, you receive the decision of the mayor, or the Basu: titleContent for Paris.
When the mayor refuses your application for urban planning authorization or takes a arrested from stay of proceedings, you can challenge his decision in 2 ways:
- Appeals to the mayor (and/or the prefect in a municipality without MORE: titleContent, nor municipal card)
- Appeals to the administrative judge.
These 2 appeals can be made independently one from the other or simultaneously.
Warning
If you are in a remarkable heritage site or to approaches to a historic monument and if the refusal of authorization is motivated by an unfavorable opinion of theABF: titleContent, you have to make a mandatory prior administrative appeal (Rapo). It must be made to the regional prefect before your appeal before the administrative judge.

Appeals to the mayor and/or the prefect
You have 1 month to make a ex gratia before the mayor from the date of notification refusal (date of deposit or postmark). If your municipality is without MORE no municipal card, within the same period, you can also submit a hierarchical redress before the prefect, in addition to the appeal to the mayor.
To make your request, you write your appeal on free paper. You hand-drop it off or send it to the town hall and/or the prefecture by post RAR: titleContent.
In the absence of a response from the mayor and/or the prefect in the 2 months which follow the date on which your appeal was sent or lodged, your request is rejected.
Appeals to the administrative judge
You have 2 months to make a litigation before the administrative judge from the date of notification the refusal of the mayor or the date of implied rejection (date of deposit or postmark as proof). This period remains 2 months, even if you have previously appealed to the mayor and/or the prefect.
To make your application, you must refer the case to the administrative judge by letter in which you justify your appeal. You don't have to hire a lawyer.
You must apply to the administrative court on which the municipality where your project is located depends.

The amendment of the initial authorization shall not entail any change in its period of validity. It is kept without being increased. Authorization is expired if you have not started works in the 3 years or if, after this period, you interrupt them for more than 1 year.
Please note
The period of validity of authorizations shall be amended according to the date of the decision:
- between 28 may 2022 and 28 may 2024: 5 years (authorization cannot be extended)
- between 1er january 2021 and may 27, 2022: the deadline is extended by 1 year
Once your request for amending authorization has been accepted, its display in the field is mandatory.
The display must remain in place throughout the duration of the project and be visible from the outside. The information on your billboard must be legible from the public highway or open spaces.
Durant 2 months from 1er display day in the field, your neighbors can challenge the amending permit which has been granted to you. They then make one ex gratia to the mayor who issued the authorization.
Please note
Viewing the amending authorization opens a new time limit for appeals, but it only covers the amendments and not the entire project.
The validity period can be extended 2 times for 1 year if the rules of urban planning and administrative easements have not changed.
You must apply for it At least 2 months before the expiry of the period of validity of your initial authorization. If you perform a 2e request, you must transmit it at least 2 months before the expiration of your 1re request for extension.
This request must be sent on free paper, in 2 copies, by letter RAR: titleContent or deposited at the town hall, or at Basu: titleContent for Paris.
Upon receipt of your request, the town hall, or the Basu: titleContent for Paris, ont 2 months to answer you.
The extension is granted if you do not receive a response within this period.
When you have completed your works on your original authorization and your amending authorization, you must send to the City Hall, or the Basu: titleContent for Paris, a Declaration of Completion and Compliance (DAACT) of your works.
The method of transmission of your DAACT differs depending on whether you are in the province or in Paris.
