An adult under guardianship, curatorship, protection of justice or family authorization may have an identity card or a passport. The intervention of its representative depends on the type of protection.

He's under guardianship

The situation varies depending on whether it is an application for an identity card or a passport:

Application for an identity card

The adult under guardianship may apply for an identity card alone, but his guardian must be informed.

In addition to the documents to be attached to the application file, the guardianship adult must provide the following documents:

  • Attestation of the guardian indicating that he is informed of the procedure. The certificate must be signed and dated within 3 months. It must include the surname, first names, date of birth and address of the guardian, as well as the surname, first names and date of birth of the adult under guardianship.
  • Photocopy of a guardian's ID
  • Last guardianship judgment.
Application for a passport

Only the guardian is entitled to apply for a passport for a guardianship adult.

The presence of the adult under guardianship is mandatory when filing the application.

The adult retains his legal capacity. He can therefore request an identity document without needing to ask the authorization of the curator.

He is under safeguard of justice

The adult retains his legal capacity. He can therefore apply for an identity document without needing to ask another person for authorization.

He's under a family license

The adult retains his legal capacity. He can therefore apply for an identity document without having to ask the authorization of the person authorized to represent him, unless the judge has limited this capacity.
