Does the absence of mandatory maintenance lead to an increase in the CPF?

The Court of Cassation ruled on the addition of the personal training account (CPF) in case of absence of mandatory professional interview (now called “career interview”).

Reminder

For companies with more than 50 employees, Article L. 6323-13 of the Labor Code states that the employee must receive a supplement on his CPF when 2 conditions are completed:

  • have not had a compulsory professional interview for 8 years (6 years at the time of the case concerned);
  • not have taken at least one non-compulsory training course (training which does not condition the performance of the activity or function).

An employee, employed in a company with more than 50 employees, takes legal action to demand payment of a abundance on his CPF. He states that he should have received such a sum because he did not receive a mandatory professional interview (scheduled every 2 years).

The Court of Appeal rejected the employee's request because he did not meet the second condition required to obtain a supplement to the CPF: not having taken non-compulsory training during the reference period. He is appealing to the Court of Cassation.

The Court of Cassation upholds the judgment handed down on appeal. She recalled that the two conditions for collecting this supplement are cumulative.

Thus, the absence of a compulsory professional interview is not sufficient to obtain an additional payment on the CPF.
