Is a video surveillance device filming a nearby path legal?

The Court of Cassation issued a ruling on the installation of a video surveillance camera filming a passage path in the neighborhood. Does such a system comply with the law?

Several individuals are suing their neighbor to have a video surveillance device settled on their property removed. According to them, this camera is oriented towards a common passage path in the neighborhood, which infringes on the privacy of the filmed passers-by.

What does justice say?

The Court of Appeal dismissed the applicants' request. According to the applicant, the presence of that camera does not constitute an infringement of the privacy of the neighbors, since it covers only a passing path. It therefore considers that there is no abnormal neighborhood disorder.

The applicants appeal in cassation.

The Court of Cassation overturns and annuls the decision rendered on appeal. For her, capturing the image of people taking this common path in the neighborhood is an infringement on their privacy.

It therefore considers that the installation of this camera constitutes an abnormal neighborhood disorder.
