Medical termination of pregnancy: you can benefit from a sick leave without a day of deficiency

A medical termination of pregnancy (MiTE) is carried out when the continuation of the pregnancy seriously endangers the health of the pregnant woman, or if there is a high probability that the unborn child is suffering from a particularly serious condition recognized as incurable at the time of diagnosis. When you need to be sick from work as a result of an IMG, you can now receive compensation without waiting period.

Since 1er in july 2024, you can obtain from a general practitioner or gynecologist a work stoppage without a day of absence if you are unable to exercise your employment after a medical interruption of pregnancy. From the first day you leave your business, you will receive the daily allowances paid by your health insurance scheme to compensate for your loss of salary.

In the context of a ‘classic’ sick leave:

The prescription of a work stoppage without waiting period is established by the healthcare professional via a specific paper form; you must then carry out the usual steps to be done on your own during a work stoppage due to illness, according to your professional status.

Part 3 of this notice of work stoppage, to be sent to your employer, is identical to that of a standard form; it will therefore not allow your employer to know the reasons for your sick leave.

Please note

Medical termination of pregnancy (MMI) is distinct from voluntary termination of pregnancy (abortion).

Reminder

If the pregnancy is terminated spontaneously (miscarriage), it has been possible since the 1ster January 2024 to benefit from a sick leave without application of the waiting period.
