Door-to-door telephone calls: the new rules

The Law Against All Aid Fraud, passed on June 30, 2025, includes a component on canvassing by telephone or electronic means. In some sectors, this type of canvassing is now strictly prohibited. Further application will be provided in summer 2026. Service-Public.fr informs you.

The consumer’s consent obligation

The Law of 30 June 2025 provides for a prohibition in principle of telephone solicitation in all sectors within one year (august 2026). The transition period should allow professionals to review their telephone prospecting methods and put in place the necessary tools for obtaining consent.

Doing business by telephone with an individual, directly or through a third party, will be prohibited if the company has not previously obtained its consent (i.e. his “free, specific, enlightened, unambiguous and revocable will”). Explicit consent is required, whether by purchase, in-store visit, or by application. The professional should be able to provide proof of consent.

Doing business by telephone will also be allowed if you are surveyed as part of a contract to which you have subscribed (including prospecting for products or services which are complementary to this contract and which are likely to ‘improve its performance or quality’).

If you object to further communication, the trader must terminate the call without delay and stop contacting you.

Penalties for abuse of weakness in connection with telephone solicitation will be increased for legal persons and companies. The various provisions relating to this prohibition will be specified by decree.

Doing so is now prohibited in the areas of energy renovation and housing adaptation

The new law prohibits from 1er july 2025 canvassing by telephone or by electronic means (emails, SMS, via social networks) in the sectors of the energy renovation and adapting housing to disability and old age. The prohibition relates to ‘the supply of services, the sale of equipment or the carrying out of works relating to dwellings with a view to achieving energy savings, the production of renewable energy or their adaptation to aging or disability’.

The purpose of this new provision is to combat fraud in renovation aid.

Be careful, it does not apply if this canvassing is done within the framework of a contract already concluded.

Reminder

Currently, companies do not need explicit permission to reach individuals. It is up to consumers to oppose calls, especially through the service Block which allows you to stop receiving unsolicited calls.
